Bankruptcy can often stop repossessions, foreclosures, wage and bank garnishments, judgments, lawsuits and IRS levies. However, filing bankruptcy can be a very complex process. Chapter 7

 

Chapter 7 for individuals or married couples may allow you to eliminate most, if not all, of your unsecured debts including credit card debt, debts that have been transferred to collection agencies, and debt from unpaid medical bills. One of the primary purposes of Chapter 7 Bankruptcy is to discharge debts to give an honest person a "fresh start." Changes to the bankruptcy regulations in 2005, includes a formula test called the “means test” to determine who may be eligible to file a Chapter 7 bankruptcy.

 

In order to confirm that you are eligible, we offer a free consultation to determine which bankruptcy chapter is the most appropriate for you. One of the key benefits of filing bankruptcy is the "automatic stay." The automatic stay requires all of your creditors to immediately stop all collection actions against you. This means that they can no longer harass you by telephone, or send you any additional bills in the mail. In addition, Chapter 7 may assist you in resolving the following issues: lawsuits, bank and wage garnishments, depositions in aid of execution, and license suspension. Additionally, Chapter 7 can offer relief from real estate mortgages and high car payments for properties and vehicles which you no longer wish to retain. If, according to the results of the formula, you have sufficient net monthly income to repay debts then you are not eligible for Chapter 7 bankruptcy but you may be eligible for relief in Chapter 13 bankruptcy.

 

 


Chapter 13

 

Chapter 13 for individuals or married couples allows you to propose a plan to pay your outstanding bills and creditors over a period of three to five years. In general, the individual gets to keep his property and his creditors end up with less money than they are owed. Chapter 13 offers some options that are not available in Chapter 7. For example, Chapter 13 offers the opportunity to save your home from foreclosure. A Chapter 13 case can stop foreclosure proceedings and can assist you in bringing your delinquent mortgage payments current by allowing you to pay the delinquent amount over a period of years. In addition, the Court allows you to make payments to your creditors based upon what you can afford, not what you owe. Once you make all of your monthly payments to the Court in your payment plan, whatever amounts remain due after you complete the plan are forgiven or discharged.
